New Civil Liberties Alliance, a conservative legal group, filed a complaint against the Trump administration on Thursday for imposing prices for Chinese imports.
Deposited before the Federal Court of Florida, the trial alleys that Trump did not have the legal authority to impose the radical rates unveiled on Wednesday as well as the functions authorized on February 1 under the International Economic Powers (IEPA).
In a press releaseThe group has described the prices as “illegal” and argued that the price tax on Chinese imports has placed a heavy burden on American taxpayers.
“In his history of almost 50 years, no other president – including President Trump in his first mandate – has never tried to use the IEEPA to impose prices,” said the NCLA.

The main lawyer for the NCLA litigation, Andrew Morris, argued that Trump, imposing heavy prices on Chinese imports, had “abused” emergency powers “, the right of the usurped congress to control the prices and turned the separation of the powers of the Constitution.”
The NCLA has filed the trial on behalf of Simplified, a retailer based in Florida of house management products.
Trump announced on Wednesday that China would be struck by a rate of 34%, in addition to the 20%it imposed earlier this year, bringing the total of new samples to 54%.
The trial requests a judge to block the implementation and application of prices and cancel Trump’s changes in the calendar of American prices.

The trial indicates that the presidents can only impose prices with the authorization of the congress and under complex commercial laws, speaking how and when they can be authorized.
“These laws require preliminary surveys, detailed factual conclusions and a close adjustment between the statutory authority and the scope of a tariff,” said the trial.
Trump has declared an emergency on the alleged complicity of China in the epidemic of American opioids, framing prices as a negotiation tool to end the influx of fatal drugs.

The NCLA said that its trial “did not chica” with Trump’s declaration of an emergency linked to opioids “, but it causes its decision to impose prices in response, without the legal power to do it”.
The case was assigned to the American district judge Kent Wetherell, a person appointed by Trump who had interrupted a key element in the immigration policy of former president Joe Biden in 2023.
