March 15, 2025, Kilmar Armando Abrego Garcia would have been taken from his house in Maryland and deported to Salvador. The move would have taken place “without evidence” behind the allegations which affirmed it as a member of MS-13. In addition, the decision occurred despite an order from the 2019 court “explicitly declaring that it should not be expelled”. Now the Supreme Court would fight for Garcia to be released from detention and found her family. In addition, the shocking error has posed a broader concern under the Trump administration: should the government be authorized to expel citizens who, according to them, are criminals?

Can the United States expel condemned citizens?
According to Burns-Tuker, Garcia is from El Salvador and had an open immigration case before his expulsion. Police allegedly allegedly alleged that Garcia is a member of the Gang MS 13 – the gang which has now been considered a foreign terrorist organization.
In addition, he ordered that all gang members were expelled immediately once identified.
On March 15, Garcia was recovered by ice agents and said that “his immigration status had changed”. In addition, in the time which followed the order, the decision would have been identified as an error by the Trump administration. By April, the Supreme Court would have decided that Garcia was immediately brought back to the United States
However, the Trump administration does not claim that it will not be able to do it so quickly.
