The judges overthrow the dismissal of Han Duck-Soo in the last twist of saga triggered by the decree of the martial law of Yoon Suk-Yeol.
The Constitutional Court of South Korea has reintegrated the Prime Minister Han Duck-Soo as an acting president, the last turn of the winding political saga launched by the dismissal of President Yoon Suk-Yeol.
The Constitutional Court of Korea judged that Han’s dismissal should be rejected on Monday during a vote of 7-1, the restaurant at the highest post in the country, while the eight judges examine the fate of Yoon separately, which was suspended from its functions after having briefly imposed martial law on December 3.
Five of the court judges concluded that there were no sufficient reasons to dismiss Han, 75, although the request for dismissal against him is valid.
Two judges judged that the motion of dismissal of the legislative assembly lacked legitimacy from the start because it had only been supported by 192 of the 300 legislators, instead of a majority of two thirds.
After being appointed interim president following Yoon’s dismissal on December 14, Han himself was suspended from his functions less than two weeks later for his refusal to appoint three other judges to the Constitutional Court.
In a television address after the decision, Han expressed his gratitude to the Court for his “wise decision” and undertook to focus on navigation on the geopolitical challenges faced by his country.
“I believe that all citizens clearly denounce the highly polarized political sphere. I think there is no more room for the division now. The priority of our country is to move forward,” said Han.
The decision comes when the Constitutional Court has not yet ruled on the advisability of confirming Yoon’s dismissal or restoring its presidential powers.
The deliberate court the fate of Yoon since mid-December and a decision should largely arrive in the days.
At least six of the eight judges must maintain the dismissal of Yoon to permanently withdraw it from its functions.
If Yoon is stripped of the presidency, an election to choose his successor must be held within 60 days.
Yoon faces criminal accusations separately, including the insurrection, as part of his decree of short -term martial law.
He is faced with a maximum imprisonment of imprisonment in perpetuity or the death penalty if he is found guilty.
